OWNER/CREW RESPONSIBILITY: Sailing always involves some level of risk from adverse weather to mechanical breakdown and failure. Each yacht captain and crew member participating in a NEMA sailing event is responsible for his/her safety. Only you can decide whether to participate in any NEMA event; participation is entirely voluntary. All those who participate in a NEMA event assume all risks associated with participation, including risk of injury and loss of life. All participants in NEMA events shall be legally and financially responsible for any physical injury or property damage they may cause to themselves or others, and participants shall hold NEMA, its officers, directors, and race organizers, harmless from any claim arising from or out of such participation. This assumption of risk and obligation to hold NEMA harmless applies to all NEMA event participants, whether or not set forth in a separate written instrument.
